1. Introduction

Welcome to Hiked ("Platform"), owned and operated by Bizgurukul Pvt. Ltd. These Terms and Conditions ("Terms") govern your access and use of our Platform, including any related services, content, and features. By accessing or using the Platform, you agree to be bound by these Terms. If you do not accept these Terms, you must refrain from using the Platform.

These Terms provide a legal framework to ensure the proper functioning of the Platform while safeguarding both users and the service provider. We recommend that you read these Terms carefully and contact us if you have any questions regarding their application or scope.

2. Definitions

To ensure clarity and prevent any misunderstanding, the following definitions apply:

  • "Mentor" refers to an individual providing guidance, advice, and knowledge-sharing services on the Platform, based on their expertise and professional experience.
  • "Mentee" refers to an individual seeking mentorship services through the Platform to gain insights, career guidance, and professional knowledge.
  • "User" refers collectively to both Mentors and Mentees utilizing the Platform.
  • "Content" includes but is not limited to any information, text, images, videos, recordings, digital files, or other material shared, uploaded, or transmitted on or through the Platform by any user.
  • "Hiked" refers to the Platform and its operators, including any affiliates, partners, or entities involved in its management.
  • "Third-Party Service Providers" refer to external payment gateways, software integrations, and services used in conjunction with the Platform to facilitate transactions, security, and other functionalities.
3. Acceptance of Terms

By registering, accessing, or using the Platform, you confirm that you have read, understood, and agreed to these Terms. If you do not agree with any part of these Terms, you must immediately discontinue using the Platform. Continued use of the Platform after modifications to these Terms constitutes acceptance of the updated Terms, and it is your responsibility to stay informed about any changes.

4. Eligibility

To be eligible to use the Platform, you must:

  • Be at least 18 years old.
  • Provide accurate, truthful, and complete registration information during the account setup process.
  • Not be prohibited by any applicable laws, regulations, or governing authorities from using the Platform.

If you do not meet these eligibility criteria, Hiked reserves the right to deny your access, terminate your account, or take any other necessary action to maintain the integrity of the Platform.

5. Account Registration and Security

Users must register an account to access mentorship services. The following conditions apply:

  • You must provide accurate, current, and complete information during the registration process, including valid identification details if requested.
  • You are solely responsible for maintaining the confidentiality of your login credentials, including your username and password.
  • You agree to take full responsibility for all activities conducted under your account, whether authorized by you or not.
  • If you suspect unauthorized access to your account, you must notify Hiked immediately to prevent any potential misuse or security breach.

Hiked reserves the right to suspend, restrict, or terminate accounts found to be providing false or misleading information.

6. User Responsibilities

As a user of the Platform, you agree to:

  • Use the Platform solely for mentorship-related activities and in compliance with all applicable laws.
  • Refrain from engaging in fraudulent, misleading, deceptive, or otherwise inappropriate conduct.
  • Avoid misrepresenting your qualifications, experience, or expertise to other users.
  • Respect the rights, privacy, and dignity of other users, refraining from any form of harassment or discrimination.
  • Comply with all Platform policies and applicable local, national, and international laws and regulations.
7. Mentor Obligations

Mentors must:

  • Provide accurate and up-to-date information regarding their expertise, experience, and credentials.
  • Conduct themselves in a professional, ethical, and respectful manner at all times.
  • Avoid providing financial, legal, medical, or investment advice unless they possess the necessary qualifications, certifications, and licensing.
  • Ensure the confidentiality and data privacy of their mentees by not disclosing personal or sensitive information without explicit consent.
  • Refrain from promoting personal businesses, services, or competing platforms to mentees outside of the Platform.
8. Mentee Obligations

Mentees must:

  • Provide truthful and accurate information when seeking mentorship and setting career goals.
  • Use the Platform and interact with mentors respectfully and professionally.
  • Avoid soliciting mentors for unrelated services or personal requests outside the scope of mentorship.
  • Respect the time, effort, and boundaries set by mentors.
9. Prohibited Conduct

Users are strictly prohibited from:

  • Engaging in harassment, abuse, discrimination, or any other form of offensive behavior.
  • Impersonating another individual, misrepresenting affiliations, or submitting false information.
  • Circumventing the Platform to establish direct mentorship relationships outside of Hiked, thereby avoiding applicable fees and policies.
  • Uploading or distributing harmful software, viruses, or any malicious code.
  • Engaging in any activity that violates local or international laws.
10. Payment and Refunds
  • Mentees are required to pay for mentorship sessions as per the rates established by the mentor or Platform.
  • All payments are final, and refunds will only be processed under circumstances explicitly approved by Hiked.
  • A refund request is only valid if made at least 24 hours before the scheduled session. Once the session takes place, no refund requests will be entertained.
  • Rescheduling is permitted if requested at least 24 hours in advance.
  • Hiked is not liable for any disputes regarding payment between mentors and mentees.
11. Revenue Sharing for Mentors
  • Mentors are entitled to payments based on a predefined revenue-sharing model agreed upon with Hiked.
  • Payment structures are subject to periodic modifications at Hiked’s discretion, with reasonable notice to affected parties.
12. Intellectual Property Rights
  • Hiked retains ownership of all branding, logos, proprietary content, and Platform-related materials.
  • Users grant Hiked a perpetual, irrevocable, and royalty-free license to use any content shared on the Platform for promotional or operational purposes.
13. Confidentiality

Mentors and mentees must uphold the confidentiality of information shared during mentorship sessions and must not disclose sensitive details to unauthorized parties.

14. Data Privacy

Hiked processes personal and professional data in accordance with its Privacy Policy. Users must review and understand the Privacy Policy before using the Platform.

15. Session Recordings
  • Hiked reserves the right to record mentorship sessions for quality assurance, training, or resale purposes.
  • By using the Platform, users consent to such recordings, which may be made available to relevant parties within the Platform’s ecosystem.
16. Platform Availability and Maintenance

Hiked endeavors to ensure that the Platform remains accessible at all times. However, we do not guarantee uninterrupted service, as the Platform may experience occasional downtimes due to maintenance, technical issues, security updates, or circumstances beyond our control. We reserve the right to suspend or discontinue any part of the Platform at our discretion without prior notice. While we strive to minimize disruptions, Hiked is not liable for any losses or damages arising from Platform unavailability.

17. Account Termination and Suspension

Hiked may suspend or terminate a user’s account without prior notice if they are found to be in violation of these Terms. Grounds for termination may include, but are not limited to, fraudulent activities, harassment of other users, misuse of the Platform, or providing false information during registration. Users whose accounts have been terminated may not create a new account without explicit permission from Hiked. We reserve the right to take legal action against individuals engaging in severe misconduct.

18. Limitation of Liability

Hiked and its affiliates shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from Platform use. This includes, but is not limited to, financial losses, reputational damages, data breaches, or business interruptions. Users acknowledge that their use of the Platform is at their own risk, and Hiked makes no guarantees regarding mentorship outcomes.

19. Indemnification

Users agree to indemnify and hold harmless Hiked, its directors, employees, and affiliates from any claims, liabilities, damages, or expenses arising out of their use of the Platform. This includes legal costs incurred in defending against such claims, whether they arise due to user conduct, violation of these Terms, or unauthorized use of another user’s account.

20. Dispute Resolution

In the event of a dispute between users or between a user and Hiked, we encourage informal resolution through customer support. If the dispute cannot be resolved amicably, it shall be settled through arbitration conducted in Noida, India, in accordance with applicable laws. Users agree that legal proceedings, if necessary, will be conducted in Noida, and waive any objections to jurisdiction and venue.

21. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of India. Any legal disputes that arise under these Terms will be subject to the exclusive jurisdiction of the courts in Noida, India.

22. Force Majeure

Hiked shall not be held liable for service interruptions, loss of access, or other failures resulting from circumstances beyond our control. These may include natural disasters, acts of war, cyber-attacks, changes in government regulations, strikes, or failures in telecommunications networks. Users acknowledge that such events may impact Platform functionality and waive any claims for damages resulting from force majeure events.

23. Compliance with Laws

Users must comply with all applicable local, national, and international laws while using the Platform. This includes laws related to data protection, intellectual property, privacy, and fair business practices. Violation of any legal provision may result in account termination and potential legal consequences.

24. Taxes and Financial Obligations

Users are responsible for any applicable taxes associated with their activities on the Platform. Mentors receiving payments for services rendered through Hiked are required to comply with relevant tax regulations and report earnings to the appropriate tax authorities. Hiked does not assume responsibility for tax liabilities incurred by users.

25. Modifications to Terms

Hiked reserves the right to modify or update these Terms at any time. Users will be notified of significant changes through the Platform or via email. Continued use of the Platform after modifications have been made constitutes acceptance of the revised Terms.

26. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue to be in effect. The invalid portion shall be modified to reflect the original intent to the fullest extent permitted by law.

27. No Waiver

Failure by Hiked to enforce any provision of these Terms does not constitute a waiver of that provision or any other right. Our rights remain enforceable at all times.

28. Intellectual Property and Copyright Protection

All content, software, and branding associated with Hiked remain the property of the Platform. Users are prohibited from copying, reproducing, or distributing Platform materials without explicit permission. Violation of intellectual property laws may result in legal action.

29. Notices and Communications

Users agree to receive communications from Hiked electronically, including emails, notifications, or messages within the Platform. Official notices related to these Terms shall be delivered electronically to the registered email address.

30. User Feedback and Suggestions

Hiked welcomes feedback, ideas, and suggestions from users regarding Platform improvements. However, by submitting feedback, users acknowledge that Hiked is under no obligation to implement or compensate for such ideas. Any suggestions provided to Hiked shall be considered non-confidential and non-proprietary, and the company may use them without restrictions or obligations.

31. Security Measures and User Responsibilities

Hiked implements rigorous security protocols to safeguard user data and prevent unauthorized access. However, users are responsible for maintaining the security of their accounts, including using strong passwords and refraining from sharing login credentials. Any suspicious activity should be reported immediately to Hiked’s support team to prevent potential security breaches.

32. Third-Party Content and Services

Hiked may contain links to third-party websites, services, or advertisements. These third-party services operate independently of Hiked, and we do not assume responsibility for their content, policies, or business practices. Users should review third-party policies before engaging with their services. Hiked shall not be held liable for damages resulting from interactions with external platforms.

33. Ethical Conduct and Professionalism

All users are expected to conduct themselves with integrity, honesty, and professionalism while using the Platform. Any form of dishonesty, including misrepresentation of credentials, manipulation of reviews, or unethical solicitation, is strictly prohibited. Violations of this clause may result in suspension or permanent removal from the Platform.

34. Assignment of Rights and Transferability

Users may not assign or transfer their rights or obligations under these Terms without prior written consent from Hiked. However, Hiked reserves the right to assign, transfer, or delegate its rights and responsibilities under these Terms without restriction, including in cases of mergers, acquisitions, or company restructuring.

35. Entire Agreement

These Terms constitute the complete agreement between users and Hiked, superseding any prior agreements or understandings. Users agree that they have not relied on any external representations outside of these Terms when engaging with the Platform.

By continuing to use Hiked, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.

General Provisions Applicable to Both Mentors and Mentees

Acceptance of Terms

  • Access to the Platform is conditional upon your acceptance of these terms. By registering or using the Platform, you acknowledge that you have read, understood, and agreed to these terms.

Indemnity

  • You agree to indemnify and hold Hiked, its affiliates, officers, directors, and employees harmless from any claims, liabilities, damages, losses, or expenses arising out of your use of the Platform.

Termination of Access

  • Hiked reserves the right to terminate your access to the Platform at any time for violation of these terms or any applicable laws.

Force Majeure

  • Hiked shall not be held liable for interruptions or failures due to circumstances beyond its control, including but not limited to natural disasters, cyber-attacks, or regulatory actions.

Governing Law and Jurisdiction

  • These terms are governed by the laws of India, and disputes shall be subject to the exclusive jurisdiction of the courts in Noida.
